ALL SALES ARE FINAL
Retainer
A retainer fee of $50 is required for all sessions. This is a non-refundable retainer.
Client must pay the retainer fee to book a session. Retainer fee must be paid to secure any date.
The remaining session balance following the session must be paid in full.
Payment Methods
Fallon Andrea Photography primarily uses Square for any invoices.
In some cases, other mobile payment apps are used as well; Such as: Venmo, Cash App, and PayPal.
Cash is accepted.
Afterpay is accepted.
Cancellation
I understand that plans can change unexpectedly. However, to manage my schedule effectively and accommodate all clients fairly, please notify me at least 72 hours in advance if you need to cancel.
Any balance paid beforehand is non-refundable.
Photographic Materials and Copyright
All photographic materials, such as original negatives, digital photos, or slides, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and may use the work for samples, contests, exhibition, advertising and self-promotion, and any and all social platforms.
Client Usage
The Client is obtaining prints and/or digital photos for personal use only.
If Client is obtaining a print and/or digital photo for reproduction, Photographer authorizes Client to reproduce the print and/or digital photo only as set forth under Special Usage Requirements. In such event, Client shall request that a copyright and credit notice for the Photographer be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.
Social Media
This applies to all social media, including but not limited to: Facebook, Instagram, TikTok, X (Twitter), etc. When published online it is required that citation of photographer be made. The Client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The Client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be altered or edited in any way.
Failure to Perform
If the Photographer cannot perform this Agreement due to a fire or other casualty or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return any funds previously paid to the Client. This also applies in the event that photographic materials are damaged in processing or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
Liability
It is Client’s responsibility to take care of any children, pets, etc; Fallon Andrea Photography will not accept any responsibility due to any accidents or damage to public or private properties during the photo shooting or consultation session.
Editing
Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view.
Touch ups such as but not limited to: skin smoothening, makeup enhancing, teeth whitening, are usually included in the Photographers editing process. Client must communicate and state to the Photographer if they do not want these included.
It is understood that Photographer is not responsible to fix photos to cover parts of your body that you do not wish to be seen in the photo, or alter the size of your body or body parts, unless it was confirmed with the photographer.
If the Client has special requests, they shall create a “shot list” of all shots (or types of edits) that they require - this will cost an extra fee.
PHOTOGRAPHER DOES NOT RELEASE RAW IMAGES.
Photo Cooperation
Due to the limited and subjective nature of events, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to: anyone in or at the event.
The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles.
The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness, or rules and restrictions of venues.
In the event that the family/guests are taking photos, Fallon Andrea Photography is not responsible for obstructed photos or photos ruined due to separate flashes going off or due to any other behavior from guests. Fallon Andrea Photography is not responsible for obstructed or ruined photos due to activities by other vendors and venue staff.
The Photographer will do its best to fulfill all requests but can make no guarantees all images will be delivered.
The Photographer is not responsible if key individuals fail to appear or cooperate during photography sessions.
Clients are responsible for all location fees and permits.
Expenses
Travel expenses such as parking or destination fees must be reimbursed to the Photographer and will be added to the balance after the event.
Travel fees are pre-determined.
Fallon Andrea Photography charges a travel fee for anywhere outside of Panama City, Panama City Beach, Lynn Haven.
In the event of traveling for extended time, the Client is responsible to pay any gas/flight or hotel fees.
Clients are responsible for all location fees and permits.
Contract signing, payment of retainer, payment of session, and use of images acts as an agreement to all Fallon Andrea Photography policies giving all rights to photos taken to be posted/used as I see fit, unless discussed otherwise (Ex.: nudity, gender reveals, special announcements, not wanting children on socials, etc.) Fallon Andrea Photography will never post without consent.
